Practitioner Agreement
This agreement governs your work as a practitioner on Divina and supplements the Divina Terms of Service and Acceptable Use Policy, which also bind you. Where they conflict as to your practitioner activity, this agreement controls.
1. You're an independent business
You are an independent business and independent contractor. Nothing here creates an employment, agency, partnership, or joint-venture relationship, and you are not eligible for any employee benefit from Divina. You decide whether to accept any order, your own prices, your own delivery windows, and your own traditions, tools, and methods. Divina does not direct or control the manner or means of any Working, and provides no scripts or required methodology. You may not represent yourself as Divina or contract on its behalf; you may describe yourself as "a practitioner on Divina."
2. Your practice stays yours
Divina is non-exclusive. You may offer your services anywhere else — your own site, other platforms, in person — before, during, and after your time on Divina. There are no minimums, no quotas, and no exclusivity.
3. Eligibility, account, and review
You must be 18 or older (or the age of majority where you live), able to form a binding contract, and able to receive payouts through our payment processor (Stripe). Payouts require completing identity verification and onboarding with Stripe, which collects your identity and bank details directly — Divina never sees or stores them. New shops are reviewed by hand before going live, and Divina may decline any application at its discretion. Your account is personal to you and may not be shared, sold, or transferred. Divina is open to practitioners in countries where the Platform and its payment processor (Stripe) lawfully operate. Because our payment processor restricts spiritual, psychic, and fortune-telling services in certain countries, Divina is not available to practitioners located in Japan, Mexico, or Thailand, or in any country subject to comprehensive sanctions or where we or our processor cannot lawfully provide the service; this list may change as our processor's rules change. You are responsible for your own local registrations and taxes.
4. Spiritual services only — no physical goods
You may offer spiritual services only. Every listing must be a service you perform and deliver through the Platform — a working with photo or video proof, a written reading, a recorded prayer, a message, or similar. You may not sell, ship, or exchange any physical or tangible goods through Divina at this time — no candles, crystals, herbs, printed or mailed items, or any object shipped or handed to a customer, and you may not use a service listing to arrange the sale of goods. Physical-goods listings will be removed.
5. Honest listings, no guarantees
Describe your Workings truthfully — what you do, what the seeker receives, and when. Your listings and claims are your own; Divina does not adopt or verify them. You must not promise, predict with certainty, or guarantee any real-world outcome, anywhere on the Platform. Workings are respectful requests, never bindings; a Working performed in good faith earns its fee regardless of result. Health-adjacent Workings must present themselves as complementing — never replacing — professional care, and may not diagnose or treat. Work involving another person must stay within the invitation-not-binding frame, consistent with the Acceptable Use Policy.
You set each listing's delivery window and confirm you can meet it. Shops that consistently run past their windows may be paused.
6. Orders, performance, and proof
Accepting an order forms a direct agreement between you and the customer; Divina is not a party to it. You choose which orders to accept — declining an order refunds the customer automatically and is never penalized in itself. You must actually perform the Working, personally, before marking it delivered. For cast Workings, deliver photo or video proof of the completed work plus a written note; for readings and prayer, deliver the written record your listing promises. Fabricated, reused, or recycled proof is grounds for immediate termination.
You must refuse — and may report — any request that violates the Acceptable Use Policy, even if asked and even for more money. You may not tell a customer they are cursed or in danger to sell additional work. All customer communication happens in Divina's in-app chat, and all payments flow through the Platform; you may not move a Divina customer to off-platform channels or payment. Public social links on your profile are fine.
7. Fees, payouts, and money flow
Divina retains 10% of the item price of each completed Working. Customers separately pay a buyer service fee that does not reduce your payout. Any promotional or reduced commission rate applies only if Divina extends it to you in a separate written offer; it is not part of these standard terms.
Payouts are made to your Stripe account, and Stripe's own terms apply to you as a condition of receiving payouts. Your payout for an order releases 72 hours after you deliver proof of the completed Working, unless the customer flags the order in that window.
If a customer credibly disputes performance, the first remedy is a re-cast or redo by you. If a refund is warranted — non-performance, a prohibited request, misrepresentation, fraud, or where law requires — it is funded from your held funds for that order. Because outcomes are never guaranteed, "it didn't work" alone is not a refund basis. If a customer's payment is charged back or reversed after your payout released, Divina may deduct the corresponding amount from future payouts. You are solely responsible for your own taxes; Divina does not withhold.
8. Content, storefronts, and seeker privacy
You keep ownership of your listings, photos, profile, and proof media. You grant Divina a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and promote that content to operate and market the Platform, including your Divina storefront and our marketing, for as long as the content is on the Platform. Listing images and proof photos must be your own work and must not misrepresent what you deliver.
Customers share deeply personal intentions with you. You must keep customer information and the content of Workings confidential, use it only to perform the Working, and never publish it — including anonymized "client stories" — without the customer's written consent.
9. Standards, suspension, and leaving
Divina may take action proportionate to the issue: content removal, a written warning, a shop pause, suspension, or termination. Fear-based upselling, baneful work, guaranteed outcomes, fabricated proof, involvement of minors, selling physical goods, and fraud may result in immediate suspension or termination. When a shop is suspended or terminated, open orders are resolved case by case, unreleased funds for undelivered Workings are refunded to customers, and released earnings not subject to dispute are paid out on the normal schedule. You may close your shop at any time; open orders must be completed or declined first.
10. Disclaimers, liability, and disputes
The Platform is provided "as is." The warranty disclaimers and liability limitation in the Terms of Service apply to you as a practitioner, with the same cap. Divina does not guarantee you any number of orders, customers, placement, or earnings; ranking and featuring are at Divina's discretion. As between you and Divina, you are responsible and liable for your Workings and their consequences, and you will defend, indemnify, and hold harmless Brooke Builds Stuff LLC and its members, managers, officers, employees, and agents from claims arising out of your Workings, your content, your breach of this agreement or the Acceptable Use Policy, or your violation of law or third-party rights. The dispute-resolution and governing-law terms in the Terms of Service (binding individual arbitration, class-action waiver, small-claims carve-out, and New York governing law) apply to this agreement.
11. Changes
We may update this agreement; we will post the new version with an effective date, and give reasonable advance notice of material changes to fees or these terms. Continued selling after the effective date means you accept the update; you may close your shop instead.
